PLEASE FAMILIARISE YOURSELVES WITH THE TERMS AND CONDITIONS OF YOUR BOOKING AS SET OUT BELOW
IT IS AGREED THAT UPON BOOKING THE PROPERTIES YOU HAVE ACCEPTED THESE TERMS AND CONDITIONS
When you make a booking, you accept on behalf of your party the terms of these booking conditions. It is your responsibility to ensure that all of the details on your confirmation documents are correct and to bring to our attention any errors or discrepancies within 48 hours of your booking. Guests are agreeing to these terms and conditions when a booking is confirmed, and payment is made. Any breach of the below short-term letting terms and conditions, as agreed by both parties, permits the owner, The Beach Havens to refuse entry, amend the rent or immediately terminate the letting.
COVID 19 CANCELLATION POLICY
Our Covid 19 cancellation policy is continually being reviewed to ensure that we are taking into account developments associated with Coronavirus (COVID-19). We are a small family-run property and cancellations do affect us.
TRAVEL DURING COVID-19 PANDEMIC
If government restrictions are placed on international or domestic travel due to the impact of Covid-19, THE BEACH HAVENS - Haven Oceana and Haven Tropicana will provide a free change of date no sooner than fourteen (14) days after and up to three (3) months from the original commencement date of the Booking (but retaining the same number of days for the Booking unless otherwise agreed by TBH), to your booking or provide a credit voucher for the amount paid for accommodation valid for three (3) months from the original Booking. All other cancellations will be subject to our normal cancellation policy.
We strongly recommend you purchase comprehensive travel insurance at the time of booking. We suggest that the policy should include, but not be limited to, the reimbursement of any monies paid in the event the travel is cancelled; loss or damage to personal baggage and loss of money and medical expenses.
BOOKINGS AND QUOTES
Bookings can be made over the internet at www.thebeachhavens.com or by calling on +61 0419 214 418. Reservations are subject to availability and
actual pricing at the time of booking. Verbal quotes are valid for 24 hours only. Any verbal quote given is an estimate only of price, which will be subject to a written advice on confirmation of booking. Bookings made through any of the booking hosting platforms - booking.com; airbnb; homestay; riparride etc are subject to the rates quoted on those sites. You agree to pay the rate for each night of your stay and any additional charges up until the time you have departed the accommodation. The accommodation may be occupied by you and the number of guests booked only, for the period stated on the booking confirmation.
Full payment is required at time of booking (with the exception of the booking platforms who offer a different payment system). If payment is not received by the due date, The Beach Havens reserves the right to cancel the booking.
A security bond of $1,000 is required to be paid for bookings with The Beach Havens. A security bond of $500 each is required to be paid for bookings with Haven Oceana and Haven Tropicana. In the event of: damage to the property, equipment, breakages or if extra cleaning is required this will be deducted from this security bond.
Payments are accepted via the booking platform or if the booking is made via our website payment is made via Stripe. All payments are only accepted in AUD dollars. Payments can also be accepted via direct deposit details will be provided if required.
RATES & CHARGES
Rates quoted are in Australian dollars and are subject to change at any time. Rates are inclusive of GST where applicable. Any verbal quote given is an estimate only of price, which will be subject to a written advice on confirmation of the booking. Minimum length of stay restrictions applies to certain rates during special event periods. The price of your accommodation cannot be guaranteed until the deposit is received or if booking online full payment is required at time of booking.
Guest Obligations and Permitted Use
The Guest agrees:
to be an occupant of the Property for the entire duration of the stay;
not to sublet or allow unregistered Guests to stay at the Property;
to comply with all applicable laws and regulations;
to co-operate with The Beach Havens and abide by these terms and conditions during their stay at the Property;
not to use the Property for any purpose other than the approved purpose as set out in this Agreement;
to close all windows at check-out and when the Guest is not present at the Property to prevent theft of or damage to furnishings or the Guest’s personal Property and to contact The Beach Havens immediately where they are not able to secure the Property;
not to use the Property for any criminal activity, including online, and acknowledges The Beach Havens will cooperate with any investigation of alleged criminal activity at the Property during or after the stay;
not to wear shoes inside the upper level of the Property at any time;
not to smoke or nap on the Property, including all guest rooms and
communal spaces, decks and outdoor areas
not to use the Property for parties and gatherings without prior
to not have pets on the Property;
to abide by the Noise and Good Neighbour Policy highlighted
in this agreement
to leave the Property in the same condition as found, returning all
furniture and styling pieces to their original location; and
not to nail, screw, staple or fix anything to any wall, door or other
surface or part of the building.
CANCELLATION TERMS & CHARGES
For direct bookings if you cancel with 3 or more months notice prior to your arrival date a 20% cancellation fee will be incurred. If you cancel between 3-1 month prior to your arrival date a 50% cancellation fee of the booking total will be incurred. If you cancel within 30 days of your arrival date a 100% cancellation fee of the booking total will be incurred. We will do our very best to rebook the property for the cancelled dates. This may require a discounted last minute rate. If the property is rebooked, the guest will be refunded for this amount minus 20% administration costs. The Guest shall only receive a refund where the dates are rebooked by TBH to another Guest. Written notification must be provided for all cancellations. No refund will be given if the accommodation is deemed unsuitable after check in. Cancellation fees charged cover accommodation costs & cleaning & linen fees charged. It does not include the security deposit.
Children’s under 2 are not charged. Children over 2 are charged full price. If requested by the owners official proof of age of children must be supplied. No additional beds, other than a port-a-cot will be supplied.
NUMBER OF GUESTS
At no time during your occupancy is the number of guests staying to exceed the number booked, unless prior approval is sought and given by the owners. The use of extra beds other than the number booked is not allowed. Extra guests exceeding the maximum occupancy in your booking will be considered trespassers and will be evicted. The maximum number of guests permitted in each property type is as follows: Haven Oceana – 6 guests, Haven Tropicana – 4 guests. You are only charged for the number of guests booked. Any number exceeding this will be deemed a breach of these Terms and Conditions. Any gathering of friends or relatives other than those booked for the duration of the stay is to be pre-approved by the owners.
CHECK IN & CHECK OUT
Standard check in time is 2.00 pm on the day of arrival and accommodation is to be vacated by 10.00 am on the day of departure. PLEASE NOTE an additional fee will be charged if you do not check out by 10.00 am. Early arrivals and late check outs are at the discretion of The Owners and must be requested at the time of booking and can only be confirmed 1 day prior to arrival or departure. Whilst every effort will be made to accommodate early arrivals and late departures, the only way to absolutely ensure early check-in or late checkout is to book an extra night.
On departure the property is to be left in the condition it was when you arrived with the exception of beds. Extra cleaning charges will apply if this condition is breached and will be deducted from your deposit or credit card. ALL of your food items are to be removed from the fridge and freezer. ALL bins are to be emptied in to the relevant council bins. ALL kitchen utensils are to be washed and stacked away. Dishwasher is to be emptied and stacked away. If you BURN any pot or pan it is too be scrubbed clean prior to being put the dishwasher. ALL kitchen utensils are to be left in the condition they were found. If used the BBQ is to be thoroughly cleaned including removal of all grease and fats from all trays.
Extra cleaning and linen change can be arranged during your stay for an additional charge, at a cost to you. Please contact the owners for further details.
The Beach Havens - Haven Tropicana and Haven Oceana are STRICTLY NO SMOKING. This includes on the deck and rear garden area. Smoking inside any accommodation is STRICTLY PROHIBITED. Smoking on the decks or in the garden is STRICTLY PROHIBITED. If there is any evidence of smoking
inside the accommodation you will be charged an additional $1000 for a specialised clean to eliminate odours.
No pets are permitted. Additional cleaning charges will apply if this condition is breached and deducted from your credit card or debit card.
You acknowledge that we do not cover your personal belongings under our insurance policy and therefore take no responsibility for any loss or damage of the occupant’s personal property left on the premises and agree that you will not make any claim against us for any damages or loss to your personal belonging regardless of how or where the loss or damage occurred.
Parties or gatherings are STRICTLY PROHIBITED, unless prior arrangements have been made with The Owners. The Beach Havens - Haven Tropicana and Haven Oceana has a STRICT no party policy.
NOISE DISTURBANCE TO NEIGHBOURS AND GOOD NEIGHBOUR POLICY
(a) The Beach Havens reserves the right to monitor noise at the Property via a noise device or other.
(b) You acknowledge that parties and gatherings are strictly prohibited at The Beach Havens without prior permission from management, and that all noise shall be kept indoors after 10:00pm and prior to 8:00am.
(c) Excessive noise, music and any other form of disturbance to neighbours and other The Beach Havens Guests is prohibited at all times and may result in an eviction without refund.
(d) Additionally, where The Beach Havens staff, security guards or the police attends the Property to deal with noise complaints or excess Guests, or where a complaint has been received from the neighbours during or after your stay, you will be charged a fine in accordance with the Schedule of Costs.
(e) Evidence of a party or function found after the Guests have checked out shall result in an additional charge.
A ‘good neighbour’ policy shall be enforced at The Beach Havens. You acknowledge that The Beach Havens will be treated with as much care as your own residence, and that it shall be left in the same condition as when you arrived. Behaviour exhibited by you and/or other Guests that is disrespectful of and disruptive to neighbours, traffic flow or the community, or which prompts complaints to The Beach Havens management from the police, local council or neighbours shall not be tolerated and may result in a fine or eviction. You and other Guests agree to abide by all applicable parking restrictions and limitations.
BREAKAGES AND DAMAGES
Upon check out accommodation should be left clean and tidy. Damages or breakages of furniture or furnishings must be reported to The Owners immediately. Breakages or damages to the property and all communal or external areas that are caused by any guest and/or a guest’s visitor will be charged and recouped in full of the guest’s credit card or deducted from the guest’s refundable deposit. Excess cleaning required on departure or replacement of items removed from the accommodation will be charged to the guest’s credit card. Furniture, fixtures and fittings are not to be altered or moved between rooms or properties. There will be a charge incurred if furniture is not returned to its original location.
Linen and bath towels provided including hand towels and face washers are not to used if spray tans are used. Guests will be charged for any damage to linen or bath towels from the use of spray tans.
LOCKOUTS & LOSS OF KEYS
Lockouts will incur a standard or after hours call out fee of $60.00 & loss of keys will incur a $350.00 replacement charge.
The properties are not to be used for commercial use or photographic use unless approved by The Owners.
You acknowledge that we do not accept liability for any injury, damage, loss, additional expenses and disruptions due to electrical storms or other acts of God caused directly or indirectly by events, which are beyond our control and agree not to make any claim in relation thereto.
You agree that regardless of your length of stay there is no tenancy or other rights created under any Landlord and Tenant laws and there are no such laws that apply to your stay.
CHANGES BEYOND OUR CONTROL
Compensation will not apply if a significant change is made for reasons beyond our control. These include: war, threat of war, riots, civil disturbances, terrorist activity, industrial disputes, natural and nuclear disasters, fire, epidemics, health risks, changes due to rescheduling or cancellation of flights by an airline or alteration of the airline or aircraft type; closed or congested airports or ports, hurricanes and other actual or potential severe weather conditions, act of government or public authorities or other circumstances amounting to force majeure and/or Acts of God.
BREACH OF TERMS AND CONDITIONS
You agree that, should you or your guests breach any of the terms and conditions: You will pay to us the total loss or damage that we suffer as a result of that breach and hereby authorise us to debit your credit card or apply your refundable deposit in payment of that loss or damage and we may evict you and your guests without notice.
The Beach Havens - Haven Oceana and Haven Tropicana attempts to have as small a rubbish footprint as possible. Food scraps (non meat) are to be placed in the small bench top compost bin provided. PLEASE FREEZE all meat or seafood scraps and only put this into the RED general waste bin the evening before it is to be collected. We implore all guests to reduce the use of plastic and plastic bags. Upon departure all rubbish and foodstuffs are to be removed from the house and placed in the appropriate bins provided - other than frozen meat and seafood scraps.
FIRE SAFETY AND THE PROPERTY
A fire extinguisher is in the kitchen of both Haven Oceana and Haven Tropicana. Please familiarise yourself with this. Charges apply for fire extinguishers discharged inappropriately You must also acknowledge that you ... must climb stairs to gain access to the upper area of The Beach Haven - Haven Oceana
PAYMENT OF DEPOSIT OR FULL PAYMENT CONSTITUTES THAT YOU HAVE ACCEPTED IN FULL THESE TERMS AND CONDITIONS
